1. DESCRIPTION

Kaitlyn’s Kloset – MN is a registered 501(c)(3) nonprofit organization. By accessing services, resources, or donations through our Facebook group, Facebook community page, and/or Kaitlyn’s Kloset – MN Resource Center, you are agreeing to the policies set forth and have read, understand, and are fully informed of the contents. If you do not wish to be bound to these policies, you must leave the group.

2. ACCESS TO KAITLYN’S KLOSET – MN

Once you access the Facebook group, Facebook community page, or Kaitlyn’s Kloset – MN Resource Center, whether directly or indirectly, it is your responsibility to read the Terms and Conditions.

3. USER OBLIGATIONS

The contents of the Facebook group, Facebook community page, and/or Kaitlyn’s Kloset – MN Resource Center shall not be exploited in anyway and you may not abuse the services offered herein. The user agrees not to post any negative, offensive, abusive, indecent, threatening, menacing, defamatory comments; or anything which is immoral, malicious of any individual, illegal or unlawful.

4. TERMS AND CONDITIONS OF ACCEPTING DONATED ITEMS

By accessing the services, resources, and/or donations, you agree that you will use the personal property donated by Kaitlyn’s Kloset – MN upon the express condition that item(s) will be disposed of immediately if not functioning properly. You are responsible for the correct use of item(s) according to manufacturers’ instructions and guidelines. By accepting donated items, you agree to inspect them before use and to check manufacturer recall lists.

In consideration for accepting personal property through Kaitlyn’s Kloset – MN, You hereby unconditionally release, waive, discharge and covenant not to sue Kaitlyn’s Kloset – MN, their administrators, donors, or volunteers (hereinafter referred to as releasees) from any liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, your child(ren), your heirs, your next of kin, and any other person, whether caused by the active or passive negligence of the releasees, or otherwise as result of accepting personal property from Kaitlyn’s Kloset – MN. You understand that many of the items donated to Kaitlyn’s Kloset – MN are used and have in turn been donated to Kaitlyn’s Kloset – MN. You are fully aware of the potential risks involved and potential hazards connected with using these items. You elect to voluntarily accept the items with the full knowledge of these risks and hazards. You voluntarily assume full responsibility for any risks of loss, personal injury, including death, that may be sustained by you, your child(ren) your heirs, your next of kin, and any other person, whether caused by the active or passive negligence of the releases, or otherwise. You further hereby agree to indemnify and hold harmless the releasees from any loss, liability damage or costs, including court cost and attorney fees that may incur as a result of accepting personal property through Kaitlyn’s Kloset – MN, whether caused by the active or passive negligence of the releasees, or otherwise. It is your express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of your family and spouse, your heirs, assigns, and personal representative.

All personally property items are donated WITHOUT ANY WARRANTY, EITHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR USABILITY FOR A PARTICULAR PURPOSE.

5.CHANGES TO TERMS AND CONDITIONS

Kaitlyn’s Kloset – MN reserves the right to make amendments from time to time to any part or all of its Facebook group, Facebook community page, and Kaitlyn’s Kloset – MN Resource Center and/or Terms and Conditions. It is the responsibility of all users to check these terms and conditions each time they are accessed. Each and every access of the Facebook group, Facebook community page, and/or Kaitlyn’s Kloset – MN Resource Center constitutes an agreement that all users are bound by the terms and conditions as amended.
